Terms of Use

These Terms cover localfindertx.com and every Finder directory edition operated by Local Finder LLC. The short version: we run directories, the businesses are independent, and you deal with them at your own risk.

1. Agreement and who we are

These Terms of Use (the “Terms”) are a contract between you and Local Finder LLC (“Local Finder,” “we,” “us,” and “our”). Local Finder LLC owns and operates localfindertx.com and the Finder family of local business directories, including WestSide Finder (westsidefinder.com), Permian Finder (permianfinder.com), and any other Finder edition we launch, such as Hill Country West Finder and Highland Lakes Finder (each an “Edition,” and together with localfindertx.com, the “Sites”).

By using any Site, you agree to these Terms and our Privacy Notice. If you do not agree, do not use the Sites.

Each Edition also has its own Terms of Use, Privacy Notice, and Disclaimer, which cover the details of that Edition (such as its covered ZIP codes, forms, pricing, and badge criteria). Those pages and these Terms work together. If they conflict about something on an Edition, that Edition’s own terms control for that Edition.

2. Who may use the Sites

You must be at least 18 years old and able to form a binding contract to use the Sites. If you use them for a business, you promise that you have authority to bind it, and “you” includes that business.

3. What the Sites are, and what they are not

The Sites are online directories of local businesses in Texas. They help people find businesses and help businesses be found. Listings are for general information only.

We are not a contractor, tradesperson, real estate agent or broker, lender, insurer, attorney, health care provider, or referral or placement agency. We do not perform, supervise, guarantee, or take part in any work or service a listed business offers. We are not a party to any agreement between you and a business, and we do not handle payments between you and a business.

localfindertx.com shows the status of Editions (for example, live, in build, or planned). Planned or exploring areas, maps, circles, counts, and dates are estimates, not promises that an Edition will launch, cover a particular place, or launch by any date.

4. Businesses are independent third parties

Every business listed on a Site is an independent third party. No listed business is our employee, agent, partner, franchisee, or joint venturer, and no business can act or speak for us. Each business alone is responsible for its own goods, services, prices, licenses, permits, insurance, staff, statements, and conduct.

5. No endorsement and limited verification

Appearing on a Site is not a recommendation, endorsement, referral, or certification of any business, person, product, or service. Apart from the limited checks described for the Locally Verified badge (section 6), we do not vet, screen, inspect, or investigate businesses for licensing, insurance, bonding, qualifications, quality of work, pricing, financial condition, background, reputation, or safety. The order in which listings appear is not a measure of quality.

Listing information comes from public sources and from business owners. It may be wrong, incomplete, or out of date. Hours, services, phone numbers, addresses, ownership, and service areas can change without notice. Confirm details directly with the business before you rely on them.

6. What “Locally Verified” means

“Locally Verified” means only what the Locally Verified page of the Edition showing the badge says it means, and nothing more. In general, it means that, when we last checked, we completed a short list of point-in-time checks, such as local presence, an active license in a state agency’s public lookup where the law requires one, active business status with the state, and a response to a test request.

The badge is not an endorsement, recommendation, rating, guarantee, or warranty of any business or of its work, prices, or quality. It does not mean the business is licensed, insured, bonded, or qualified for your job, background-checked, or safe. We rely on public records and on what businesses tell us, and those can be wrong or change after we check. We may remove a badge at any time. The badge is not for sale.

8. Your dealings with businesses are your responsibility

Any contact, quote, agreement, payment, work, product, or service between you and a business is only between you and that business. Before you hire or deal with any business, you are responsible for your own research, including checking licenses, permits, insurance, and references, and getting a written estimate or contract.

Any dispute about a business’s goods or services, including about price, quality, delay, damage, injury, warranty, or payment, is between you and that business. We have no duty to take part in or resolve it. To the fullest extent the law allows, you release Local Finder LLC from claims, demands, and damages of every kind, known or unknown, arising out of or connected with any such dispute or with your dealings with any business.

In an emergency, call 911. Do not use the Sites to look for emergency help.

9. Listed businesses

If you claim, add, manage, or pay for a listing, you promise that you are authorized to act for the business; that everything you give us is accurate, current, and not misleading; that you have the right to give us any text, logos, and photos you submit; and that your business and your listing comply with all laws that apply, including licensing, advertising, and consumer protection laws.

You give us a non-exclusive, royalty-free, worldwide license to host, copy, format, display, and distribute the content you submit to operate and promote the Sites. You keep ownership of your content. We may edit for format, decline, suspend, downgrade, or remove any listing, content, placement, or badge at any time, as described in the Edition’s Terms.

A business owner can ask for a listing to be corrected or removed using the Edition’s claim or removal pages, or by emailing support@westsidefinder.com.

10. What you send us

Messages, suggestions, form entries, and other material you send us (“Submissions”) must be accurate and must be yours to send. Do not send payment card numbers, government ID numbers, passwords, or health information. You give us a non-exclusive, royalty-free license to use, store, and display your Submissions to run, check, and improve the Sites and to respond to you. Where a Submission is a request meant for a business, we may pass it to that business. We are not required to respond to, publish, or act on any Submission. We handle personal information as described in our Privacy Notice.

11. Prohibited conduct

You agree not to:

  • break any law or anyone’s rights, or use the Sites for a fraudulent, deceptive, harassing, or defamatory purpose;
  • post fake or unauthorized listings, claims, or removal requests, or pretend to be someone you are not;
  • scrape, harvest, or bulk-copy the Sites or their listings, or use bots to access them, except ordinary search engine indexing we allow;
  • use listing data to send spam, build a competing directory, or resell or republish listings;
  • use the Locally Verified badge, our names, or our logos without permission, or misrepresent a business’s status; or
  • interfere with, overload, or try to get around the security of the Sites.

12. Third-party links and services

The Sites link to and use websites and services run by others, including business websites, social media pages, government license lookups, map providers, and Stripe checkout pages. We do not control them, are not responsible for them, and do not endorse them. Your use of them is at your own risk and under their own terms and privacy policies.

13. Our content and marks

The Sites, their design, text, code, maps we prepare, and compilation of listings are owned by us or our licensors. “Local Finder,” “Local Finder TX,” each Edition name, “Locally Verified,” and our logos and badges are our marks. You may view the Sites for your own personal, non-commercial use. All other rights are reserved. To report material you believe infringes your copyright or other rights, email support@westsidefinder.com with the web address, a description of the problem, and your contact details.

14. Disclaimer of warranties

THE SITES, ALL LISTINGS, BADGES, MAPS, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND TIMELINESS.

WE DO NOT WARRANT THAT THE SITES WILL BE AVAILABLE, SECURE, OR ERROR-FREE; THAT ANY LISTING OR INFORMATION IS ACCURATE OR CURRENT; THAT ANY BUSINESS IS LICENSED, INSURED, QUALIFIED, SAFE, OR RELIABLE; OR THAT ANY GOODS OR SERVICES OF ANY BUSINESS WILL MEET YOUR NEEDS.

15. Limitation of liability

WE ARE NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, GOODS, SERVICES, WORK, PRICES, OR STATEMENTS OF ANY BUSINESS, OR FOR ANY DISPUTE, PROPERTY DAMAGE, PERSONAL INJURY, DEATH, OR OTHER LOSS RESULTING FROM YOUR DEALINGS WITH ANY BUSINESS FOUND OR LISTED ON THE SITES.

TO THE FULLEST EXTENT THE LAW ALLOWS, LOCAL FINDER LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SITES OR THESE TERMS, UNDER ANY THEORY OF LIABILITY.

TO THE FULLEST EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM.

These limits apply to every kind of claim, whether in contract, tort (including negligence), statute, or otherwise. They do not limit liability that the law does not allow to be limited, such as for fraud or willful misconduct. Some states do not allow certain limits, so some of them may not apply to you.

16. Indemnification

Listed businesses. If you list, claim, manage, or pay for a listing, you agree to defend, indemnify, and hold harmless Local Finder LLC and its members, managers, officers, employees, contractors, and agents from and against all claims, demands, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your goods, services, work, prices, advertising, or conduct; (b) any injury, damage, or loss suffered by any customer or other person in connection with your business; (c) your listing content and Submissions, including any claim that they are inaccurate or infringe someone’s rights; (d) your use of the Locally Verified badge or our marks; and (e) your breach of these Terms, an Edition’s Terms, or the law.

Everyone. You also agree to defend, indemnify, and hold us harmless on the same terms for claims arising out of your Submissions, your misuse of the Sites, or your breach of these Terms. If you use the Sites only as a consumer, this applies to the extent permitted by law. We may take over the defense of any matter at our own expense, and you will cooperate.

17. Changes, suspension, and termination

We may update these Terms. The “Last updated” date shows the current version. Using a Site after a change takes effect means you accept the new Terms. We may change, suspend, or end any Site, Edition, area, feature, or listing at any time. Sections that by their nature should survive (including 4 through 8 and 14 through 19) survive any end of your use.

18. Governing law, informal resolution, and courts

These Terms and any dispute arising out of or related to them or the Sites are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules.

Talk to us first. Before filing a claim, you agree to send a written notice of the dispute to support@westsidefinder.com describing the problem and what you want, and to try in good faith to resolve it informally for at least 30 days. We will do the same. This does not apply to requests for urgent court orders to prevent harm or to small claims.

Courts. If a dispute is not resolved within 30 days, it must be brought only in the state or federal courts located in Tarrant County, Texas, and you and we consent to the personal jurisdiction of and venue in those courts. Small claims. Either of us may instead bring an individual claim in small claims court (in Texas, a justice court) if it qualifies. We do not require arbitration.

19. General terms

  • Entire agreement. These Terms, our Privacy Notice, each Edition’s own terms, and any written terms for a paid placement make up the whole agreement between you and us about the Sites.
  • Severability. If part of these Terms is unenforceable, it will be enforced to the extent allowed, and the rest stays in effect.
  • No waiver. Not enforcing a right is not a waiver of it.
  • Assignment. You may not transfer these Terms without our written consent. We may assign them, including in a merger, sale, or reorganization.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of hosting or other providers.
  • Relationship. Nothing in these Terms makes you and us partners, joint venturers, agents, or employer and employee, and they create no third-party rights.
  • Interpretation. Headings are for convenience only. “Including” means “including without limitation.”
